Why do you need to make or review your Will?

In basic terms, if you do not make a Will then you have no control over what happens to your Estate when you die. In Queensland, the Succession Act sets out what would happen, but that may be not what you expect or what you want. It also means that the process of administering your Estate will be likely to take longer and to be more expensive.

If you consult a solicitor and ask them to prepare your Will, they should also help you consider some important issues such as what property will be in your Estate, who you might appoint as your executors, and who might challenge your Will and can you do anything about that?

If you have made a Will, it is vital to keep it under review. Your wishes may have changed, or your life circumstances may have changed. If you get married or divorced then your will has been affected anyway, so you need to review it. Having children, or acquiring stepchildren are also good reasons to review your Will.

Remember, if you simply change your mind about what you want, until you do something about it, the old Will still applies.
